Referral Partnership Program Terms and Conditions

These TERMS of use pertain to an Individual and or Companies usage and participation in the Hosts of America Referral Program.  We reserve the right to change or amend these TERMS.  Your participation in this Referral program means you AGREE to the following TERMS:

1. JOINING THE PROGRAM: By filling out the Referral signup form you will automatically become a Hosts of America Referral. Your participation in the program is solely for this purpose: to legally advertise the Hosts of America site and products and receive a commission on sales generated by your referrals. You also agree to receive periodic mailings to Referrals regarding the Hosts of America Referral program.

2. REVOCATION OF REFERRAL STATUS: Your Referral application and status in the program may be suspended or terminated for any of the following reasons: inappropriate advertisements (false claims, misleading hyperlinks), spamming (mass email, mass newsgroup posting, etc...), advertising on sites containing or promoting illegal activities, and violation of intellectual property rights.

3. LINKING TO HOSTS OF AMERICA: You may use graphic and text links both on your website and in emails. Hosts of America may also be advertised "offline" in classified ads, magazines, and newspapers. You may use the graphics and text provided to you by Hosts of America, or you may create your own as long as they are deemed appropriate according to the conditions in paragraph 2.

4. REFERRAL COMMISSIONS: You will be paid referral fees for every Hosts of America plan purchased. This referral fee will be $20.00 for each new hosting customer. Referral commissions will be paid out quarterly. Commissions checks will be printed and mailed in the month following the end of a quarter based on the information you provided at sign-up. Quarters run from January to March, April to June, July to September, and October to December. However, if the referral fees payable to you for any calendar quarter is less than $25.00, we will either hold payment until the total amount due is at least $25.00 or you can request a credit towards your hosting account with us. If the referred product was refunded, the membership cancelled, or money was reimbursed, Hosts of America reserves the right to deduct the appropriate commissions from the Referral's account. Hosts of America will not pay a commission when an Referral makes a Hosts of America purchase and generates a commission for themselves. Hosts of America will pay a commission when an Referral makes a purchase and generates a commission for a different Referral.

5. REFERRAL TRACKING: After signing up for the program you will receive a unique Referral URL which you will use to advertise our website. When someone clicks through http://www.hostsofamerica.com a cookie will be set in their browser with your Referral ID and their IP address will also be logged with your Referral ID. During that visit to our website or any later visit, when a purchase is made the commission will be given based on the existence of the cookie or a match of the IP address in the database.

6. TERMS OF THE AGREEMENT: These terms will begin upon your signup with the Hosts of America Referral program and will end when either you or Hosts of America terminates your Referral status. Hosts of America may modify the terms of this agreement at any time. If any modification is unacceptable to you, your only choice is to terminate your Referral status. Your continuing participation in the program will constitute your acceptance of any change.

7. LIABILITY: Hosts of America will not be liable for indirect or accidental damages (loss of revenue, commissions) due to Referral tracking failures, loss of database files, and any results of "intents of harm" to the program. We make no claim that the operation of Hosts of America will be error-free and will not be liable for any interruptions or errors.
